Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Consumer: A natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.

  • Entrepreneur: Natarya, based in Almere, offering products/services remotely.

  • Distance contract: A contract in which, in the context of a distance sale of products or services, only one or more distance communication techniques are used up to and including the conclusion of the contract.

  • Durable data carrier: Any means that enables the consumer or business to store information addressed personally to him in a way that allows future retrieval and unaltered reproduction.

  • Right of withdrawal: The possibility for the consumer to terminate the agreement within the reflection period without giving any reason.

  • Model form: The model form for withdrawal as prescribed by law.

Article 3 – Applicability

These general terms and conditions apply to all offers from Natarya and to all agreements concluded between Natarya and the consumer.

For offers or agreements involving products or services with specific conditions (e.g., customized solutions, subscriptions), additional terms and conditions may apply. These will be explicitly stated in such cases.

Deviations from these general terms and conditions are only binding if agreed upon in writing.

Article 4 – The Offer

All offers on the website are without obligation, unless explicitly stated otherwise.

The offer contains all the information the consumer needs to make an informed decision, such as price, shipping costs, delivery method, delivery times, the existence or non-existence of the right of withdrawal, and the payment methods.

Natarya strives to accurately represent images, descriptions, etc., but variations in color, packaging, or details may occur.

Article 5 – The Agreement

The agreement is concluded when the consumer has completed the ordering process and confirmed the order.

Natarya will confirm receipt of the order via email.

If Natarya doubts the accuracy or completeness of the data provided by the consumer (such as address or payment details), it may request verification; pending this, the execution of the agreement may be suspended.

Article 6 – Right of Withdrawal

The consumer has the right to cancel the agreement within 14 calendar days without giving any reason. The cooling-off period begins on the day after receipt of the product.

To exercise this right of withdrawal, the consumer must notify the order in a timely manner via email or the model form. The model form is available at [link to model form].

The product must then be returned within 14 days of revocation, with accessories, in its original packaging, unless this is reasonably impossible.

During the cooling-off period, the consumer must handle the product with care; he may only use it to the extent necessary to assess whether he wishes to keep it.

Article 7 – Costs in case of withdrawal

The consumer bears the cost of return shipping, unless Natarya has indicated that this cost is free.

Natarya will refund the full purchase price, including standard shipping costs (where applicable), within 14 days of notification of the withdrawal, unless the product has not yet been received; in that case, within 14 days of receipt or proof of return shipment.

If the product is damaged due to careless use, a reduction in value may be charged.

Article 8 – Exclusion of the right of withdrawal

Natarya may exclude the right of withdrawal for:

  • Products that, for hygienic or health protection reasons, are not suitable for return and whose seal has been broken (such as opened food products).

  • Products that spoil quickly or have a limited shelf life.

  • Products whose price is tied to fluctuations in financial markets over which Natarya has no influence.

Such exclusions are clearly stated in the offer.

Article 9 – The price

All prices listed on the website are inclusive of VAT, unless otherwise stated.

Shipping costs are listed and charged separately, unless free shipping applies from a certain order amount (this will be clearly communicated).

Natarya reserves the right to change prices until the consumer has confirmed the order.

Article 10 – Conformity and warranty

Natarya guarantees that products comply with the agreement, specifications, and reasonable requirements of quality and usability.

Any additional warranties from manufacturers remain valid, without prejudice to the statutory warranty.

Defects or incorrectly delivered products must be reported in writing within 2 months after the consumer has discovered the defect.

Article 11 – Delivery and performance

Orders are processed with the utmost care.

Delivery will take place at the delivery address provided by the consumer.

Natarya aims to deliver within 1-3 business days within the Netherlands, unless otherwise stated.

If delivery is delayed or not possible, the consumer will be informed in a timely manner.

If delivery by Natarya proves impossible, it will offer the consumer an alternative or termination of the agreement.

Article 12 – Duration of Transactions: Duration, Termination and Renewal

In the case of a fixed-term agreement, the agreed contract duration applies.

For contracts of indefinite duration, a notice period of a maximum of one month applies, unless otherwise agreed.

Article 13 – Payment

Payment is made when placing the order via the offered payment methods: including iDEAL, credit card, PayPal, Klarna Pay Later.

Additional terms and conditions apply when paying afterward, as set by the relevant payment service provider.

The consumer is obliged to provide correct payment details and to report any changes to them immediately.

In case of non-payment, Natarya may charge reasonable costs, within legal limits.

Article 14 – Complaints procedure

Natarya has a complaints procedure. Complaints about products or services can be sent to hello@natarya.nl.

The business owner will try to respond to complaints within 14 days.

If the complaint cannot be resolved to the consumer's satisfaction within that time, the consumer will be informed about the further procedure.

The consumer has the option to submit a dispute to the European ODR platform ([link ODR]).

Article 15 – Disputes

All agreements between Natarya and the consumer are governed by Dutch law.

Disputes will initially be resolved through mutual consultation. If this is not possible, the competent court in the Netherlands will be involved.

Article 16 – Additional or Deviating Provisions

Additions to or deviations from these terms and conditions are only valid if agreed upon in writing.

If any provision in these terms and conditions is invalid or is declared invalid, the remainder of the terms and conditions shall remain in full force and effect. In such case, Natarya will formulate a replacement provision that approximates the intent of the original provision as closely as possible.
